I spent 9 weeks in prison and 10 weeks on tag in 2004 for fraud wanting to go to America for a 2 week holiday would I be allowed in or would I have problems also my wife has been done for benefit fraud but did not get a prison sentence

Personally, the US is mainly worried about crimes of moral turpitude (meaning depravity, lewdness with children or animals, serious drug crimes involving sales (not merely possession), assault and battery, rape, murder, kidnapping, or terrorism). It appears your crime (and that of your wife) does not fall into this category, and therefore you should be allowed into the US for holiday.
Now if you were trying to become a US citizen or stay here on a green card (permanent visa), you would have a major problem because of the conviction..but that's another story.
But like I said, the expert on here is Terry, so please contact him and ask his opinion.
Your best bet is to apply for a vacation VISA because then you have more of a safety net. I'm pretty sure you could be denied because you were denied entry into the country before and actually did do time on the matter. Best of luck though!
