My partner has a waiver of eligibility that expired in May. He has had 3 of these previously , none of which took 6 months to process. He went for his interview in May and we have not yet been asked to send his passport for the waiver to be applied. We assumed, wrongly, that the waiver would arrive in time for our early September holiday. We are now thinking of getting a new passport, completing the ESTA with nos and hoping....has anyone ever done this successfully?

Well, if they had, they wouldn't be advertising it on here, since that would mean they had committed a crime.

I presume that by now you are contacting your passport office or the US state department to explain the need to get your case expedited. They will do this, you just need to show them you paid-for ticket.

This happens here in the US all the time--and they recently changed the rules to speed this up here by allowing local post offices to vouch that the people lived there for a long time (based upon mail deliveries) which has slowed down or prevented the need to do long background checks before issuing US passports.

What we have actually discovered is that my partner has not committed a crime of moral turpitude so to say no to that question on the ESTA would not be fraud. We have contacted the US Embassy but I don't think they will discuss individual cases or expedite the waiver.

Well, that's good news;--and I agree with you that the US Embassy is unlikely to discuss individual cases. However, in your case, just marking "No" on the ESTA should be sufficient--and if it comes up when you arrive in the US (highly unlikely) just explain it there as you have here to me.

Thats ok.....its hard to write everthing down and I do have a tendency to ramble!

My only fear is that becasue his visa is in the system that the ESTA may be denied. I wish we had never applied. Its very confusing that the Embassy web site mentions any arrest but the ESTA only mentions CIMT.

We are going to apply for the ESTA this eveing and see what happens.....wish us luck and thank you for taking the time to respond.

Well it's not good news.....the ESTA was denied so despite CBP saying the visa has no bearing on the ESTA and vice versa, clearly it does! However I am in contact with the CBP and if I send the police certificate and court records they will review his case. All is not yet lost but its getting very close! I will let you know how it all pans out . Thank you for taking the time to respond.....☀
