hi,I overstayed in Australia for 2 days,I lived there for 2 years,It was an accidend...now I'm on the risk category and I have the 3 years exclusion time.I have all my life in Australia.I want to apply for a Student visa and go back as soon is possible.I want to live there!I'm disperate!should I'll be able to go back?I went to the Immigration office by myself because I was looking to apply for a new visa,there they found that I overstayed for 2 days...now I want go back with a Student Visa.
Australian Immigration can be a real pain in the proverbial ass. You could appeal the 3 year exclusion stating your reasons but i feel they will think you want to live in Australia and are trying to take a short cut to get here. I dont think they would approve a student visa while you are on the 3 year exclusion and with a student visa you need to have been accepted and enrolled to study at a recognised educational institute and i believe that its not cheap as far as student fees etc are concerned.
A last resort may be to get someone here to sponsor you, to act as a surity for you, as in they will be responsable for your ongoing support while you are here. That may work.
