i am in desperate need of information...My children were charged with an assault to another man in the UK. we had misread( as parents) a letter from a constabulary dept giving him a warning re the charge and thought it was finished with so sent one of children on his pre arranged travel in Australasia ( indefinite travel time). To our horrified surprise sometime later we had the police at our door looking for his arrest as he hadn't gone to court. this warrant for his arrest is still outstanding. question 1. if he leaves Australia to say thailand then wants to get back into Australia over the next few weeks will he be stopped and extradited back to the Uk. ( he is due home in September)
Question 2. Our other son who has been going through the legal process for this 'assault' of which even though they did not start the fight looks as though they will be found guilty due to too much force in defending themselves( ie injuries inflicted). he is so depressed with it all he announced he is going to travel as he cant face this process.. however much we persuade him to stay and face this he has arranged to leave... will he be stopped on leaving our country and /or trying to enter Australia via Bali. they are both adults ... 22yrs .& 24yrs of age but still our children and are very anxious about this . they say they would much rather suffer the consequences later than now.
Not sure about UK laws but from my understanding of US criminal history is that misdemeanors and/or low level felonies and the warrants associated don't impact international travel. Meaning that your sons probably won't get stopped at the airports or border crossings but they will definitely have to face it later and at that time it will be more serious. Better to consult a lawyer or public defender though to be safe. Good luck...
