Please help-Scheengen visa question that is complex.

Hello Everyone,

1) You don't require a short-term Schengen visa as a US citizen. After having spent 90 days outside the Schengen area, you can simply re-enter (Technically, your maximum of 90 days doesn't need to be consecutive. You can leave and re-enter as often as you wish, as long as your total stay doesn't exceed 90 days in any 180 day period)

2) I don't see how this is relevant

I have the feeling your situation isn't that complicated. Maybe I have misinterpreted your question, though. Also, your recap is not congruent with the questions you ask. But to be brief: your desired schedule is not going to work.

Im basically hoping to extend a visa- Ive already been in the Schengen for 90 days and i dont want to leave for 90 days..only 30 days.

1) After spending 90 days in the Scheengen, can I leave the country and apply for a Visa in my home country (USA)? Does this application have to be after the 6 month rule or can I apply for a Visa during this 180 day period?

Yes you can apply for a student visa to Switzerland before the 180 days are up. But you should apply for a date of entry that is after the 180 days.

This is not a problem because visa processing times can be quite long.

2) If "yes" to 1- I am eligible for a student visa or a travelers visa..Is one better or easier than the other to be accepted?

A traveller's visa would be a tourist visa. As a US-citizen you do not need to apply for a tourist visa, you can come over visa-free as long as you follow the Schengen rules. THerefore it is not possible for you to apply for a tourist visa right now.

What you need to do is to apply for a D-type visa to Switzerland, a visa that allows you to settle in Switzerland.
Looking at all the options mentionend:

http://www.eda.admin.ch/eda/en/home/reps/nameri/vusa/ref_visinf/visusa.html

the best solution for you seems to be a student visa.

Nov.2 arrived Switzerland
Jan 25 depart Switzerland

Jan 26 Arrive US
March 1 Depart US

March 1- April 25 in Switzerland....Is this possible???

No.

Nov 2nd to Jan 25th= 85 days.

First date of entry for a stay that is longer than 5 days is therefore May 1st.

Im basically hoping to extend a visa- Ive already been in the Schengen for 90 days and i dont want to leave for 90 days..only 30 days.

Impossible.

The only way to extend your stay in Schengen Area would be to apply for a residency permit in Germany ASAP, without going back to the USA at all.
