Dear Ben,
I am not English but know enough to tell you that the UK has one of the toughest laws on marriages (together with the USA) especially with so many people getting married as a scam to relocate whereby the British guy is then paid for his services.
If you really love your Gambian girlfriend like i suspect you do, you'll do right by her by fast-tracking it to the Home-office to get the information you need to do things legally and in time.
At the end of the day, it woud be tough to stop you from marrying from any nationality in the 21st century but your country could make it pretty difficult for you hoping you would have fallen out of love with the grief they'll give you. I am African and proud of your sincerity in even wanting to try. All the best.

I am only an expert on German immigration and visa, not on UK laws on the subject, but my advice would also be to contact the home office and the registrar's office ASAP. Don't expect them to be very helpful, but they might point you in the right direction. Especially the people in the registrar's office should have some basic information on the requirements for an UK citizen marrying a Gambian.

Get in touch with the UK embassy in Gambia and the Gambian embassy in the UK. Get to know the people who work there, they should be your new best friends. Talk to other people from Gambia in the UK if possible, ask them about marriage laws. Ideal would be somebody knowledgeable about law (maybe a lawyer) who is originally from Gambia.

Getting married will be tough, be prepared for a lot of hassle and imcomprehensible paperwork. And once you are married there will be even more paperwork concerning the visa for a permanent stay.

In Germany getting married to a foreigner is really hard, especially when it involves citizens of African countries. One of the big problems is that in some cases you can simply buy an original(!!!) birth certificate or passport in the streets for 50 USD, thus easily creating completely new identities. This is a real problem for governments in Europe. They want to double- and triple-check. This has led to a "wedding tourism" - people from all over the EU travel to Denmark and Spain to get married to their non-EU partners. (Denmark and Spain are sometimes the last resort/only option for a legal marriage in Europe bc the requirements are more lax there.)

I am very fond of her and understand that the only way for us to be together would be to marry her.

My question to you is can I marry her whilst she is here now or do I have to wait for her to return to Gambia and then marry her in Gambia?

Are you asking simply about marrying her in the UK?

Or, as others have presumed on this thread, are you also asking about being together in the UK after marriage - i.e. are you also asking about UK settlement visas on the basis of marriage to a British citizen?

It's unclear from what you wrote where you intend to reside after marrying - i.e. UK, Gambia, elsewhere...
